This website (www.peris.es) is owned by PERIS CORREDURÍA DE SEGUROS S.A. (hereinafter PERIS) and aims to provide Internet users with information about the services and activities provided by the company, as well as to display its corporate image.

The use of the website www.peris.es implies unconditional acceptance of the following Terms & Conditions of use. For this reason, we request that you carefully review them before using this website. If you do not agree with any of  the legal Terms & Conditions of this website, we remind you that you should refrain from using it.

We also inform you that PERIS, as the owner of the website, reserves the discretionary right to change, modify, add, delete, or replace these Terms & Conditions at any time, without prior notice to users. Consequently, we recommend that you visit this section each time you access this website in order to review the content of these Terms & Conditions and any changes made to them.

Insurance: Civil Liability and Financial Capacity Insurance arranged as provided for in current legislation.

Conflict Resolution Mechanisms: To handle and resolve complaints and claims, the Broker has a Customer Service outsourced to Inade, Instituto Atlántico del Seguro, S.L., located at Calle La Paz, 2, Bajo, 36202-Vigo (Pontevedra), and email atencioncliente@inade.org. This Service is obliged to resolve such complaints or claims within a maximum period of two months from the date of submission. If the resolution is not satisfactory, you may contact the DGSFP Claims Service, provided that you can prove that you have filed the complaint or claim in writing to our Customer Service.

Remuneration: The insurance mediation services provided by the Broker are remunerated through a commission received from the insurance company, the amount of which is included in the insurance premium.

Participations or Interests with Insurance Entities: The Broker does not have any participation in any Insurance Entity nor is it participated by any such entity.

  1. – Service Information

In accordance with the provisions of Royal Decree-Law 3/2020 of February 4,  on urgent measures incorporating the European Union directive on the distribution of private insurance into Spanish law, we inform you that Peris Correduría de Seguros S.A. (hereinafter PERIS) is the owner of the website and acts on behalf of its clients, carrying out the activity of insurance distribution by offering independent and professional advice based on an objective analysis of a sufficient number of insurance contracts available in the Spanish insurance market, personalized according to the information obtained from its clients, and always with the aim that they can contract the products that best suit their profile and interests, all according to our professional criteria and our more than 50 years of experience in the market.

Through this website, PERIS offers its clients the possibility to request the contracting of insurance policies, although the decision to insure or not the risk requested by our clients corresponds solely and exclusively to the insurance companies with which we collaborate.

Data Protection: In accordance with the provisions of Article 6.1 of Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights, and in the General Data Protection Regulation, (EU 679/2016), the client is informed that the requested personal data will be processed by the Broker in its capacity as data controller.

The purpose of the processing is necessary for the complete execution of the insurance contract and, in particular, for the maintenance of the relationship established between the Broker and the client, the advice and information on the conditions of insurance contracts and financial products, assistance in the event of a claim, the conclusion of the contract, and the sending of commercial communications, solely in relation to the risks affecting the insured and the insurance products intermediated by the Broker. No automated decisions will be made based on the commercial profiles that we may develop to offer you the products and services that best suit your needs.

The legal basis for the processing is the consent provided by the client for the execution of the mandate entrusted to us as an insurance broker to advise, propose or carry out preliminary work for the conclusion of the insurance contract, the conclusion of this contract, and/or the management and execution of these contracts, in particular, assistance in the event of a claim, and the legitimate interest of the Broker for the sending of commercial communications about products similar to those that may be contracted at any given time.

Your personal data may be transferred to other companies, including insurance brokers (natural or legal persons), whether they are part of the Group or not, when the contract results from collaboration with them or when it is necessary for internal administrative purposes, including the processing of client personal data. Likewise, we inform you that your personal data will be transferred to the insurance companies with which we collaborate to provide you with independent advice services, as well as to subscribe to the insurance policy that best suits your needs.

The client may exercise the rights of access, rectification, opposition, limitation of processing, deletion, and portability of their data by contacting the Broker’s address at C/ Andrés Mellado, 112, 28003 Madrid or at the email address proteccion.datos@peris.es, indicating the specific right they wish to exercise and attaching a copy of their current ID card (front and back).

  1. – Right of Withdrawal

We inform you that, by virtue of the provisions of Article 10 of Law 22/2007, of July 11, on the distance marketing of consumer financial services, you have a period of fourteen (14) calendar days to withdraw from the insurance contract you may have contracted, without the need to indicate the reasons for withdrawal and without any penalty, provided that the insured event has not occurred. This period will start counting from the date of conclusion of the contract or from the day you receive the contractual conditions and other legally required information.

This withdrawal period will be thirty (30) calendar days if the concluded contract is for a life insurance policy of more than six months. From the date the right of withdrawal is communicated, the insurer’s risk coverage will cease, and the policyholder will be entitled to a refund of the premium paid, except for the portion corresponding to the period during which the contract was in force.

The right of withdrawal will not apply to those insurance contracts signed to fulfil an insurance obligation of the policyholder.

Unless expressly stated otherwise, access to this website grants you a limited, non-transferable, and non-exclusive right to use, view, and browse through it, allowing you to use the provided material for your personal and non-commercial use.   • __utmt: used to throttle the request rate. Its duration is 10 minutes.

  • __utmc: This cookie is configured to interact with urchin.js. Previously, this cookie operated in conjunction with the __utmb cookie to determine whether the user was in a new session or visit. Its duration is equal to the session duration.
  •  __utmv: Used to store user-defined variable data. This cookie is created when a developer uses the _setCustomVar method with a visitor-defined variable. The cookie is updated every time data is sent to Google Analytics. It has a duration of two years.
  •  __utmz: Stores the traffic source or campaign that explains how the user reached the site. The cookie is created when the JavaScript library executes and is updated each time data is sent to Google Analytics. It has a duration of six months.

Why do we process cookies that involve personal data?

The company only uses the information collected through cookies for statistical purposes, to analyze the visits received on our website and the generic origin of these visits.

The data controller does not use this data to create individualized profiles of its users.

7.- Exclusion of Guarantees

Please be aware of the following exclusions of guarantees:

  1. a) Exclusion of guarantees and liability for the operation of the website

PERIS does not guarantee uninterrupted access and correct functioning of this website, nor that it is free from defects, errors, computer viruses, or other harmful components.

In the event that PERIS detects any of these anomalies, it will try to rectify them as soon as possible, but it will not assume any liability in this regard, especially concerning possible infection of your computer by a virus hosted on this website.

Therefore, we recommend that before starting to browse this website, you have antivirus software installed and properly updated, allowing you to detect any possible virus that may have infected this page. Despite this recommendation, we also inform you that the installation of antivirus software and its updates do not provide absolute protection against possible infections by computer viruses.

The exercise of any action related to the use of this website or these Terms & Conditions will be subject to the jurisdiction of the Courts of Madrid Capital (Spain), waiving any other jurisdiction that may correspond to you.

If any provision contained in these Terms & Conditions is found to be illegal, void, or for any reason ineffective, it will be excluded from these Terms & Conditions and will not affect the validity and effectiveness of the remaining provisions.

11.- Whistleblowing Channel

We have an Internal Information System to comply with Law 2/2023, of February 20, regulating the protection of persons who report regulatory violations and the fight against corruption, to detect possible irregularities early within the organization and take preventive measures to prevent their future occurrence, contributing to the continuous improvement of internal control processes.

The Internal Information System guarantees the confidentiality of the person reporting infringements committed in the entity, protecting them against reprisals, discrimination, and any other type of unfair treatment.

The company also guarantees accessibility to the Internal Information System and the protection of the informant through the technological platform integrated into the internal information system, whose purpose is the management, registration, and conservation of the actions that take place as a result of the presentation of information to which Law 2/2023 applies.
